Abstract |
Background. The active development of modern legal relations leads to the fact that even extraordinary and exceptional moments of life are subject to legal regulation. Their ubiquitous legislative regulation is often associated with fixing such a syntagm as “exceptional case” in the normative texts. In connection with the wide distribution of this syntagm in the legal sphere, new subtypes of this concept appear. This determines a detailed analysis of the existing typology of exceptional cases. The purpose of research is to identify and form a list of criteria, according to which it is possible to classify exceptional cases in law. Materials and methods. The vector of research aims at studying legal documents, where the syntagm “exceptional case” is normatively regulated. At the same time, not limited to legislative acts of the federal and regional levels, the doctrinal sources of a theoretical nature are used for research purposes. In his research, the author turns to dialectical materialism, as well as to the system-structural and logical method. Results. In the course of the analysis, more than 15 differentiating grounds for determining various types of exceptional cases are established. The rules for choosing bases for the stratification of a real or similar phenomenon are generalized and listed. Conclusions. The exceptional case as a terminological component of legal reality has a polymorphic nature. The diversity of its types today is at a fairly high level. Nevertheless, it should be noted that the number of possible typical variations of an exceptional case directly depends on the content of the legislative provisions. |
